“Dear PG HOA Members and Residents —
As you know, we recently negotiated a settlement with WMATA regarding the way forward with the traffic circle after WMATA utilized eminent domain to take an easement over the circle for the duration of the construction of the PY Metrorail Station. Final deficiency monies from WMATA were deposited with United States District Court for the Eastern District of Virginia on Friday, May 3, for a total settlement amount of $73,778.73. We are still in the process of confirming that the monies have been finally disbursed from the Court to the Association, we hope to have a final update on that soon.
Attached is the Stipulated Final Judgment that includes all the Terms and Conditions of the settlement agreement. We negotiated a higher $ per square foot value for the traffic circle compared to what Old Town Greens received for the tennis courts and the tot lot, but on an overall much smaller land area, to arrive at the $73.8k settlement. Again, the settlement requires WMATA to restore the circle to substantially the same condition as it exists today upon conclusion of construction. Additionally, WMATA will work with the City to permit a pocket park for the area near the existing traffic circle to mitigate some of the impact on our community.
